NOTE: As set forth in the Pricing Plan, the prepaid fee which the company will be required to pay should it enroll in the Program is determined according to whether, in the Firm's judgment, the company falls into the "small" or "medium" size category. The Firm's determination will be made clear in the Engagement Letter that will be sent to the contact person named above after the Firm's confirmation that the company is an appropriate candidate for the Program. Any questions concerning that determination, how it was reached, and whether it is subject to negotiation can be raised at that time by phone or email. The Firm reserves the right to decline any applicant's enrollment in the Program prior to sending an Engagement Letter. There shall be no engagement or representation until enrollment in the Program has been consummated by executing and returning the Engagement Letter with the required fee.
Important Limitation on Quantity of Service: The PRE-PAID AVIATION COUNSEL PROGRAM is not intended to provide a company or individual with repeat, high-volume legal services. The Pricing Plan contemplates that although the extent of utilization will vary from one client to the next, on average clients will have occasional and modest needs throughout the one-year term that will not significantly exceed the usage assumptions of the Pricing Plan. For that reason, every Engagement Letter sent to a prospective enrollee will specify that there shall be a cap, or ceiling, on the number of hours annually that a client is entitled to under the Program, as follows:
